Georgia State Election Board actions
ATLANTA — The Georgia State Election Board held its quarterly meeting on Thursday, February 14.
The Board voted to close the following cases:
* SEB Case No. 2007-000020 Gwinnett County.
* SEB Case No. 2007-000026 Hancock County.
* SEB Case No. 2007-000033 City of Doraville.
* SEB Case No. 2007-000035 City of Lavonia.
* SEB Case No. 2008-000011 Forsyth County.
The Board voted to defer further action on the following case until completion of an investigation by the Georgia Bureau of Investigations:
* SEB Case No. 2007-000013 Dade County.
The Board voted to refer the following cases to the Attorney General's Office for negotiation of a consent order:
* SEB Case No. 2007-000041 Fulton County.
* SEB Case No. 2007-000046 City of Braswell. The Board also requested that the City of Braswell be added to the case as a respondent.
The Board ruled in SEB Case No. 2007-000024 involving Mrs. Jasmine Tate that Fulton County should remove Mrs. Tate from the voter registration rolls.
The Board voted to accept the following Consent Orders from the Attorney General's Office:
* SEB Case No. 2005-00028 City of Resaca.
* SEB Case No. 2005-000073 Heard County.
* SEB Case No. 2006-000019 Calhoun County.
* SEB Case No. 2006-000032 City of Dawson.
* SEB Case No. 2006-000036 Ray City.
The Board voted to defer action on the following consent order until pending legislation has passed:
* SEB Case No. 2004-000082 Pierce County.
In SEB Case No. 2007-000012 Lowndes County, the Board voted to recommend the Attorney General negotiate a Consent Order with the respondent.
In other business, Deputy Secretary of State Rob Simms presented a legislative update to the Board regarding federal and state elections legislation.
Elections Division Director Mike McCarthy briefed the Board on the February 5, 2008 Presidential Preference Primary and other current elections issues.
The Board voted to adopt the following rules:
* SEB Rule 183-1-1-.01: Sets forth a method by which persons may petition the State Election Board to pass a new rule, change an existing rule or repeal an existing rule.
* SEB Rule 183-1-1-.02: Provides the method for extending the time for the State Election Board to consider an initial decision by an Administrative Law Judge.
