Probation revoked for accused murderer

A Dalton man charged in the shooting deaths of his father and brother and the shooting of his mother had his probation from a previous conviction revoked during a hearing in Whitfield County Superior Court on Wednesday.

Standing in red prison garb before Chief Judge William T. Boyett, Emilio Canales pleaded guilty to possessing a 9-mm handgun and a .45-caliber handgun on April 29 of this year, the same day on which he is accused of shooting his family members.

Canales’ father, Emilio Canales Sr., and brother, Francisco Emilio Canales, died after being shot, while his mother, Deborah Canales, was injured, officials have said. The family was living at 1011 N. Dude St.

Because of a previous conviction for aggravated assault in August 2006, Emilio Canales was not allowed to possess guns, officials said. Court records show Boyett issued another order to revoke his probation in October 2009 on the basis that he committed aggravated assault and possessed a firearm during the commission of a crime.

District Attorney Bert Poston said his office is still waiting on some additional information before moving forward on the charges connected with the shootings.

“The case will be indicted once we have autopsy reports and have reviewed everything,” he said. “(There is) no date set yet, but it should be this fall.”
